This limitation of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication-line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence or under any other cause of action.

Geoterraimage License terms


License and Copyright

The data supplied are licensed by GEOTERRAIMAGE to the Client, but remains the property of GEOTERRAIMAGE as is protected by copyright laws. The data can be used by the client as per the conditions set forth in the offer. The client does not obtain any ownership or intellectual property rights in the data. “Client” refers to the South African Department of Environmental Affairs. The following shall always be clearly mentioned: (© GEOTERRAIMAGE - 2014). OPEN DATA LICENSING (PERMITTED & INTENDED DATA USE) The Department is granted an Open Data User license, which allows the Department unrestricted access to and use the supplied data. The data is defined as the 72 Class GTI South African National Land Cover Dataset (2013/2014). The Open Data License allows the Department to distribute the data unrestricted to third parties with the full understanding that the Department and third parties may not use the data to develop new products that will compete directly with GEOTERRAIMAGE existing or “in-progress” commercial data products; and that the Department and third parties accept and understand the stated Data Copyright, Licensing and Liability conditions.

Liability

The Client has to verify prior to his commitment, the adequacy of GEOTERRAIMAGE datasets and products to the specific data and analyses needs as set out by the client. GEOTERRAIMAGE will in no event be liable for any direct, indirect, incidental or consequential damages including lost savings or profit, legal fees, lost data, lost sales, loss of commitments, business interruption, including loss of or other damage, resulting from its datasets and products, whether or not GEOTERRAIMAGE has been advised of the possibility of such damage. This includes damages incurred by the client or any third party. GEOTERRAIMAGE datasets and products are processed from sources like topographic maps and satellite images. The quality of these sources is not the responsibility of GEOTERRAIMAGE. The data and data products are provided “as is”, without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
